Because David’s Housing Agency Vietnam is paid a flat commission by the landlord of the building you eventually choose, we are able to offer our services to any foreigner working and living in Vietnam at no charge to you. DHA has the lowest commission of any agency in Vietnam, ensuring that high costs are not passed on to you down the line in the form of higher rents.

Under current Vietnamese law, foreigners are not currently allowed to own either residential of commercial property in the country. However, there are discussions underway about altering this law, and you can be sure that we will update you on this web site should any changes occur!

In accordance with current legal documents now, If you want to rent a residence in Vietnam you should show your visa that valid longer than 06 months. And you also have to be working at a company, organization registered in Vietnam, a certificate paper will be asked when you move in.
For renting a office, your company either has to be now in Vietnam or your application documents of open representative office, setting up company . . . has been approved.

The permit to rent a house, office . . to Foreigners has been officially rejected, from now on who having a full ownership of his, her properties will be able to rent his, her house to foreigner.

Only landlords who have legally obtained an official Permit to Lease Houses to Foreigners issued by the pertinent city or provincial Land & Housing Service can rent houses to non-Vietnamese citizens
This law is not taken lightly by Vietnamese authorities! Landlords who are caught illegally renting to foreigners face fines of US$5,000. More importantly for you, the tenant is also fined US$2,000. For this reason, David’s Housing Agency only deals with landlords who already have proper permits to rent to foreigners.

The lease contract will come into effective after being signed and the move in date is upon the lessee and lessor agreement. You can move in right after signing your lease contract.

Vietnam's Citizenship Law (VCL) applies to ONLY ONE nationality regulation - Article 3 of VCL says: The Social Republic of Vietnam recognizes Vietnamese citizens as having 01 nationality, which is Vietnamese Nationality.
However, VCL does not apply a regulation of naturally excluding nationality, which means it does NOT prohibit a person with a Vietnamese nationality from having a foreign nationality or a person with a foreign nationality from having a Vietnamese nationality. Vietnamese citizens are regarded as losing their Vietnamese nationality only in the following cases: *** Authorized leaving off nationality; *** To be deprived of nationality according to International treaty of which Vietnam participated in or signed. (Article 23 of VCL).
In principle, except to the mentioned cases of losing Vietnamese nationality, you can admit to the second nationality and keep your Vietnamese nationality if it is allowed under the law of the country where you are going to register your second nationality.

Depending on whether the property is managed by DHA or the landlord will effect the amount of involvement we will have with you and the property during your tenancy.

No, most landlords prepare their own lease contracts although Vietnamese law certain key clauses to be included. Lease contracts will be in Vietnamese although there is usually an English translation - the Vietnamese version will be controlling. Some landlords insist on signing two contracts - a lease contract and a service contract - in order to reduce their tax liabilities.
Contracts can either be signed by a resident's sponsor, usually the employer, or by an individual who has permission to stay in Vietnam for six months or longer. Generally once you and the property owner have come to a basic agreement (i.e. rent, starting date, etc.) a draft of the contract will be faxed to you or the person in your company in charge of such matters. Particulars of the lease agreement may need to be negotiated after which two formal copies of the lease agreement will be made to be signed and held by each party.
Where DHA is leasing a property, we typically recommend following one of our own standard lease agreements. Tried and tested, our lease provides a clear reference for tenants and landlords alike. Our property agents will be pleased to discuss and review the document with you once you've shortlisted the houses you are interested in leasing.

Advance rent The first rental payment will usually vary between three to 12 months, depending upon the size and location of the property. Thereafter, rent is typically paid quarterly in advance.
Deposit Security deposits are not yet commonly required for houses.
Service Charges Any service or maintenance fees are almost always included in the monthly rent.
Duration House lease contracts are generally for one to two years.
Break Clauses Break clauses are usually possible in the case that the tenant is transferred away from the city of residence or the organisation for which the tenant works closes down. Wider clauses can be negotiated in some cases. Two months notice is usually required for cancellation.
Utilities Power, water, gas and telephone charges are typically the responsibility of the tenant although you should ensure that there is no 'service fee' added to consumption charges. Your DHA agent will help make the arrangements for utility connections if required.

Houses leased on a long term basis are usually furnished with major items of furniture including beds, dining tables, sofa sets, armchairs, etc. although the range and quality of the furnishings will vary from property to property. Your DHA agent will discuss with you the furnishing options available and confirm your requirements regarding what is supplied in the property to best suit your needs.
Kitchen appliances such as refrigerators and stoves are provided. Clothes washers, dryers and microwaves are sometimes provided, but dishwashers are not common.
Almost all accommodation is air-conditioned with split units, with tenants paying for the electricity consumed.
Tenants have to provide their own linen, crockery, cutlery.

The landlord may choose to organise the inventory or this may be done through eHomes. Although most landlords don't require a security deposit when renting a house, the tenant is legally responsible for any damages to the property and the landlord may attempt to reclaim the cost of damages before you move out. A professionally conducted inventory at the start of the lease will help prevent any later disputes - ask your DHA agent for advice on making an inventory.

Televisions are not generally included in a house lease, however, it should be possible to negotiate for one if necessary. Many house owners have already installed satellite television in their properties although they may require the tenant to pay for certain satellite subscription fees.

the neighborhood I live in has almost doubled in rent prices since I signed my lease a year ago. My landlord (and many others around here do as well I hear) wants to break my lease and increase the rent. There have been no problems and I have always paid the rent on time. They just want to get more. Do I have any options here?

Until we have read your lease contract, no specific recommendation can be given. Why do not you ask for help from the agent who introduced the house to you, they would have good actions

If the landlord is an enterprise which trading apartment leasing (can see in its investment licence) and I lease an apartment in their premises for 1 year. I heatd that I have to sign the lease contract with the landlord before the notary public. Is it so?

we are French arriving end of August to live in Hanoi. Would you know if we are supposed to pay taxes to customs on arrival of all our moving stuff at the airport such as electronics, tv, house goods etc... if it's not brand new, for our own use and brought back with us when we leave the country ?
